Terms of Service

1. Acceptance

These Terms of Service (the “Terms”) govern your use of the Fitout Audit website at www.fitoutaudit.com and the services offered through it (together, the “Service”). By creating an account, uploading a document, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. What the Service does

Fitout Audit provides independent, informational reviews of interior fit-out Bills of Quantities, material specifications, and contractor quotations, using a combination of AI-assisted extraction and a UAE market-rate database. The Service produces a report with confidence-scored variance and, at the client's option, an expert-delivered review by a qualified engineer.

The Service is not: a certified cost estimate, a professional engineering opinion, a legal opinion, or a substitute for sign-off by a licensed engineer or quantity surveyor. Contractual and construction decisions must be made on the advice of your own licensed consultants.

3. Your account

• You must be 18 or older to create an account.
• You are responsible for keeping your credentials secure and for all activity that happens under your account.
• You must provide accurate information and keep it up to date.
• You may close your account at any time by emailing hello@fitoutaudit.com.

4. Documents you upload

You retain all rights to the documents you upload. By uploading, you grant us a limited licence to process them solely for the purpose of delivering the audit you requested, generating your report, and storing your account history. Uploaded documents are processed by third-party services described in our Privacy Policy and are not used to train shared or public AI models.

You represent that you have the right to upload the documents you share with us and that doing so does not violate any third party's rights, contracts, or applicable law.

5. Payment

• An Instant AI Review costs AED 149 per document. The report is unlocked in full after successful payment.
• The Expert Engineering Review is quoted after we scope your project.
• All fees are in United Arab Emirates Dirham (AED) and are inclusive of any applicable taxes, unless stated otherwise.
• Payment is handled by our PCI-DSS-compliant payment provider. We do not store your card details on our servers.

6. Refunds

Because the Instant AI Review is delivered digitally and immediately, the AED 149 fee is non-refundable once the report has been unlocked, except where required by applicable UAE consumer protection law. If the Service fails to produce a report due to a technical error on our side, we will re-process the audit at no additional charge or refund the fee, at our discretion.

7. Confidence, accuracy, and disclaimers

Every result we present is accompanied by a confidence label (“High”, “Medium”, or “Preliminary”). These labels reflect the strength of the underlying match and data source. Market rates change; our database is a snapshot in time.

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we make no warranties, express or implied, about the completeness, accuracy, reliability, or suitability of the Service for any particular purpose. Any reliance you place on the Service is at your own risk.

8. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Fitout Audit, its affiliates, employees, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service. Our total aggregate liability in any twelve-month period will not exceed the fees you paid us in that period, or AED 1,000, whichever is greater.

9. Prohibited use

You agree not to: (a) upload documents you do not have the right to share; (b) attempt to reverse-engineer, scrape, or overload the Service; (c) use the Service to build a competing product; (d) use the Service for any unlawful purpose. We may suspend or terminate accounts that breach these rules.

10. Our intellectual property

The Service, including the pricing database, matching engine, report templates, and website, is our property or licensed to us. Nothing in these Terms transfers ownership of our intellectual property to you. You may use your generated reports for your own projects and share them with your own team and consultants; you may not publish or resell them.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if we are legally required to do so, or if we discontinue the Service. On termination, your right to use the Service ends immediately; sections that by their nature should survive (disclaimers, limitation of liability, intellectual property, governing law) will remain in effect.

12. Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute that cannot be resolved by good-faith negotiation will be submitted to the exclusive jurisdiction of the Dubai courts.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email to account holders, and continued use of the Service after the change constitutes acceptance of the updated Terms.
